Council Tenant Factsheet: tenancy enforcement

Tamworth Borough Council is committed to ensuring that all tenants understand their responsibilities and that homes are occupied appropriately. This leaflet explains what happens when tenancy rules are broken and how the Council responds.

Tenancy Fraud
We take tenancy fraud seriously. This includes:

  • Subletting your council home without permission
  • Not living in the property as your main home
  • Giving false information to obtain a tenancy

We may carry out ID checks and home visits. If fraud is suspected, we will investigate and may take legal action to recover the property.

Abandoned Properties
If you plan to be away from your home for more than 28 days, you must inform the Council. We will investigate if we believe a property has been abandoned. If confirmed, we may serve a Notice to Quit and take possession.

Legal Action and Possession
We aim to work with tenants to resolve issues. However, legal action may be taken if tenancy conditions are breached. This could include court orders or eviction. We will always try to:

  • Help tenants manage rent arrears
  • Offer support through housing services
  • Safeguard vulnerable residents

Evicted tenants may be considered intentionally homeless and could face difficulties in being rehoused.

Antisocial Behaviour (ASB)
ASB includes nuisance, disorder, and crime. We work with tenants, police, and other agencies to tackle ASB. Examples include noise complaints, harassment, and vandalism.
