Summary

Under certain circumstances, the Tamworth Borough Council can issue a Temporary Exemption Notice where a person having control of or managing a house in multiple occupation (HMO) that requires a licence under Part 2 of the Housing Act 2004 (OPSI website) notifies Tamworth Borough Council of their intention to take steps with a view to securing that the house no longer requires to be licensed. 

The TEN exempts that property from being licensed for a period of 3 months (from the date the Notice is served). In exceptional circumstances, Tamworth Borough Council may serve a second TEN that lasts a further 3 months and that takes effect when the first TEN ends. No further TENs can be served after the expiry of the second TEN.
 
The Private Housing Enforcement Team will not use these notices routinely, and therefore, a second notice will only be used in exceptional and unforeseen circumstances agreed by the Assistant Director of Housing.

Application evaluation process

Each application will be considered on its own merits.

Processing timescales

Tamworth Borough Council will make a decision on your application for a Temporary Exemption to licence a licensable HMO within 30 days.

Will tacit consent apply

Tacit consent does not apply.  It is in the public interest on the grounds of public safety that Tamworth Borough Council must process your application before it can be granted.
